Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and BRANDVERTISE AGENCY (“we”, “us”, “our”), a business registered in India. They govern your access to and use of the Brandvertise website, application, and related services (the “Services”) at brandvertise.net.

“Brandvertise” is the product and brand name under which BRANDVERTISE AGENCY provides the Services. By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

2. The Services

Brandvertise provides AI-assisted tools for brand onboarding, content generation, scheduling, and (where enabled) publishing to connected social platforms. Features may change as we improve the product. Certain capabilities require third-party platform approvals (for example Meta, Pinterest, LinkedIn) and your authorization to connect those accounts.

3. Accounts

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. You must be legally able to enter contracts in your jurisdiction. If you use the Services on behalf of a company, you represent that you have authority to bind that company.

4. Your content and brands

You retain rights to content you upload (brand assets, copy, product images, and similar). You grant us a limited license to host, process, and display that content solely to operate the Services for you — including generating outputs and publishing when you request it. You represent that you have the rights needed for any material you provide and for any social accounts you connect.

AI-generated outputs are provided for your marketing use subject to these Terms and our Acceptable Use Policy. You are responsible for reviewing outputs before publishing.

5. Plans, payments, and billing

Paid plans, credits, and subscriptions are sold by BRANDVERTISE AGENCY. Charges may appear on statements under that registered name (or a payment-gateway merchant descriptor derived from it). Prices are typically shown in Indian Rupees (INR) unless stated otherwise.

Payments are processed by third-party gateways (for example Razorpay). By purchasing, you authorize us and our payment partners to charge the selected method for the plan or credits you choose, including renewals where applicable. Taxes (including GST, where applicable) may be added as required by law. Refunds, if any, follow our then-current refund practice and applicable consumer law; contact support@brandvertise.net for billing help.

6. Third-party platforms

Publishing and inspiration features depend on third-party platforms (Meta, Pinterest, and others). Those platforms have their own terms and policies. We are not responsible for outages, API changes, account suspensions, or content removals by those platforms. You must comply with each platform's rules when connecting accounts or publishing through Brandvertise.

7. Acceptable use

You must use the Services only for lawful purposes and in line with our Acceptable Use Policy. We may suspend or terminate access for violations, abuse, or risk to other users or platforms.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BRANDVERTISE AGENCY disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. AI outputs may be inaccurate or unsuitable; you must review them before use.

9. Limitation of liability

To the fullest extent permitted by law, BRANDVERTISE AGENCY is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising from the Services is limited to the amounts you paid us for the Services in the three (3) months before the claim (or INR 5,000 if greater and if you have not paid us in that period), except where liability cannot be limited by law.

10. Termination

You may stop using the Services at any time. We may suspend or end access if you breach these Terms or if we discontinue the product. Provisions that by nature should survive (including payment obligations, IP, disclaimers, and liability limits) survive termination. For deletion of personal data, see Data deletion instructions.

11. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after the effective date constitutes acceptance where permitted by law.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you.
